Is it legal for a doctor to over prescribe a medication to give the extra meds to the less fortunate?

I'm no expert on this subject. I'm not legal council or anything, but this sounds pretty sketchy to me. Especially the bringing them back part. Anyone could do something to those pills during the time difference between receiving them and giving them back. I would say that the doctor is not making a good choice.
